A substitute motion was made by Mr. Pico, and seconded by Mayor Tarver, that <br /> Ordinance No. 1629 be introduced, as recommended by staff, to be read by title 0nly and <br /> waiving further reading thereof, approving the application of Peter Shutts for a major <br /> modification to an approved PUD Development Plan as filed under Case PUD-91-19-1M. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Pico and Mayor Tarver <br /> NOES: Councilmembers Mohr and Scribner <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 7b <br /> AP-94-02, Affected Party: Mannie Joel and Martha Gr¢i~t <br /> Appeal of a decision of the Planning Director whether proposed private roadway <br /> improvements by Mannie Joel and Martha Greist Conforms to an existing PUD. The <br /> existing private road is located on the Moller Ranch, generally west of the Foothill <br /> RqS0/IVIuirwood Drive (north) street intersection (SR94: 188) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> In response to Council's questions, Mr. Swift described the proposed pipeline and pump <br /> station. He believed that the improvements were consistent with the PUD. Mr. Swift then <br />- explained the City standards that govern private driveways/streets. <br /> <br /> Ms. Dennis inquired about the City's responsibility regarding the safety of the road and <br /> the pipeline, etc. <br /> <br /> Mr. Roush explained that the proposed Condition regarding this subject was written so <br /> that staff could observe what work will take place, could determine the timing of the work and <br /> could ensure that the work meets the Code requirements. Mr. Roush suggested that Council <br /> could approve the application with the requirement that the matter be returned to Council for a <br /> final approval of the plans before the work proceeds. <br /> <br /> Mr. Tarver declared the public hearing open on the application. <br /> <br /> Lynn Bowers, Civil Engineer, 4466 Black Avenue, explained that his firm was hired by <br /> David Glenn to review this application and staff report. He gave his opinion of the legal status <br /> of the roadway and explained his belief as to the public and private interests in the roadway. (A <br /> copy of a judgement establishing the roadway easement was given to Council.) Mr. Glenn was <br /> not in opposition to the roadway being approved. Mr. Glenn would like to see professional <br /> designs, supervision, control inspection, etc. Mr. Bowers believed that this would be in the best <br /> interest of all parties involved. <br /> <br /> 07/05/94 5 <br /> <br /> <br />
