Mr. <br /> McKeehan did agree with having two fees rather than a unitary fee. <br /> <br /> Brad Hirst, Equity Enterprises, 6280 W. Las Positas, supported Mr. McKeehan's <br /> comments. He requested that this item be continued to allow Council to review the total <br /> package of fees. He was greatly concerned with the proposed park dedication fee combined with <br /> the new water connection fee. <br /> <br /> There being no further testimony, Ms. Dennis declared the public hearing closed. <br /> <br /> Ms. Scribner asked if staff had considered a land acquisition program as Mr. McKeehan <br /> had suggested. <br /> <br /> Ms. Bengtson explained that the park is developed with the residential area and not <br /> before the residential area is built. The funds are received with residential development which <br /> are tied in with a neighborhood park or community park. <br /> <br /> Mr. Roush felt that Council is not precluded from including the cost of off-site <br /> improvements. If the developer provides land in lieu of paying the fee, the City requires the <br /> sub-divider to provide, without credit, street improvements and utility connections. He was not <br /> aware of this matter being successfully challenged in other cases and therefore, he did not <br />- recommend that the section be removed from the ordinance. <br /> <br /> Ms. Mohr did not object to continuing this item for a few weeks to allow Council to be <br /> sure that none of the questions raised this evening would leave the City vulnerable to a challenge <br /> later. Ms. Mohr agreed with Mr. McKeehan's comments. <br /> <br /> Mr. Pico did not want to delay the process any further. He spoke in support of staff <br /> recommendation. <br /> <br /> It was moved by Mr. Pico, and seconded by Ms. Dennis, finding that the fair market <br /> value of land for purposes of establishing an in-lieu park dedication fee shall be $221,676/acre <br /> and amending the Municipal Code and Resolution 92-100 to establish an in-lieu park dedication <br /> fee of $4,195 for a single-family residential unit and $3,042 for a multiple-family residential <br /> unit. <br /> <br /> The r011 call vote was as follows: <br /> AYES: Councilmembers Dennis and Pico, <br /> NOES: Councilmembers Mohr and Scribner <br /> ABSENT: Mayor Tarver <br /> ABSTAIN: None <br /> <br /> Due to a tie vote, this item was continued to the July 5, 1994 City Council meeting. <br /> <br /> 06/21/94 5 <br /> <br /> <br />
