Evans Company for 146-unit development It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Ordinance No. 1623 be adopted, approving the application of A.F. Evans Company for a rezoning to the PUD (Planned Unit Development) - HDR (High Density Residential) - District and development plan approval to allow a 146-unit apartment project to be situated on approximately 7.4 acres, located at 5300 Case Avenue (PUD-94-01). In response to Mr. Pieo's questions, Mr. Lure explained that staff is researching whether other residents are in the same situation as Mr. Schneider and could request a credit. Ms. Scribner asked when the $6,000 assessment was paid. Mr. Roush answered over an 18 year period, beginning approximately 1965. John Markely, 620 Greystone Terrace, Orinda, representing Mr. Schneider, gave a brief summary of the history of this land and of the City Council's actions in the past. He believed that there is a contractual obligation which the City assumed. He stated that proration is not appropriate and that request will give what Mr. Schneider deserves. Frank Lehne spoke in support of Mr. Schneider's request. He believed that increasing the credit would be only fair. Mr. Roush and Mr. Lum were not aware that any other residents had requested such a credit. 06/21/94 10
