The r011 call vote was as follows: <br />AYES: Councilmembers Dennis, Mohr and Scribner <br />NOES: Councilmember Pico <br />ABSENT: Mayor Tarver <br />ABSTAIN: None <br /> <br />(2) Ordinance No. 1623, Approval of Application of A.F. Evans Company for 146-unit <br />development <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Ordinance No. 1623 <br />be adopted, approving the application of A.F. Evans Company for a rezoning to the PUD <br />(Planned Unit Development) - HDR (High Density Residential) - District and development plan <br />approval to allow a 146-unit apartment project to be situated on approximately 7.4 acres, located <br />at 5300 Case Avenue (PUD-94-01). <br /> <br />The r011 call vote was as follows: <br />AYES: Councilmembers Dennis, Mohr, Scribner and Pico <br />NOES: None <br />ABSENT: Mayor Tarvet <br />ABSTAIN: None <br /> <br />Item 10e <br />Reo_uest of George Schneider for credit against water connection charges (SR94:204) <br /> <br /> Mr. Roush presented the staff report. <br /> <br /> In response to Mr. Pieo's questions, Mr. Lure explained that staff is researching whether <br />other residents are in the same situation as Mr. Schneider and could request a credit. <br /> <br /> Ms. Scribner asked when the $6,000 assessment was paid. <br /> <br /> Mr. Roush answered over an 18 year period, beginning approximately 1965. <br /> <br /> John Markely, 620 Greystone Terrace, Orinda, representing Mr. Schneider, gave a brief <br />summary of the history of this land and of the City Council's actions in the past. He believed <br />that there is a contractual obligation which the City assumed. He stated that proration is not <br />appropriate and that request will give what Mr. Schneider deserves. <br /> <br /> Frank Lehne spoke in support of Mr. Schneider's request. He believed that increasing <br />the credit would be only fair. <br /> <br /> Mr. Roush and Mr. Lum were not aware that any other residents had requested such a <br />credit. <br /> <br />06/21/94 10 <br /> <br /> <br />
