In response to Ms. Dennis, Mr. Lum further explained when the City assumed the system <br /> that was designed to service the area that made up the assessment district. <br /> <br /> Mr. Roush disagreed with the statement that the City had a contractual obligation to Mr. <br /> Schneider. <br /> <br /> There was general discussion regarding the Pleasanton Township Water District, the <br /> City's obligation according to the Municipal Code, and the option of refunding the monies. <br /> <br /> Mr. Pico asked when PMC § 14.08.090 was adopted and what the statute of limitations <br /> was. He then asked that this matter be continued until additional information was available from <br /> <br /> It was moved by Ms. Scribner, to refund Mr. Schneider half of what he has requested, <br /> $3,011. This would eliminate the amount of staff time it would take to research the matter. <br /> <br /> The motion died for lack of a second. <br /> <br /> Ms. Dennis did not object to crediting Mr. Schneider as Ms. Scribner had suggested, <br /> however, she was concerned with not doing the research necessary for any further requests. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Dennis, to continue this item to the <br /> July 5, 1994 City Council meeting and ask that staff review the history of PMC §14.08.090. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr, Pico and Scribner <br /> NOES: None <br /> ABSENT: Mayor Tarver <br /> ABSTAIN: None <br /> <br /> Council took a break at 9:50 p.m. <br /> <br /> Council re, convened at 9: 56 p.m. <br /> <br /> Item 10b <br /> AccePtance of Alameda County Economic Development Board's Red Tape Round Table <br /> Report (SR94:134) <br /> <br /> George Withers, Fire Chief, presented the staff report.
