Ms. Dennis asked if Westbrook would object to adding the Fish and Game requirements <br />into the Conditions of Approval. <br /> <br /> Mr. Pico was reluctant to approve the project without the approved drawings of the <br />project. He agreed with Planning Commissioner Barker's concern that the City should be <br />requiring a two year guarantee from the developer with respect to all major improvements. Mr. <br />Pico appealed this item. <br /> <br /> Scott Shaull, Westbrook Housing Group, pointed out that the grading documents do <br />include the 30 foot setback. He asked that Council not appeal this item because he felt that the <br />drawings were adequate. <br /> <br /> Mr. Pico then withdrew his appeal. <br /> <br /> No action was required or taken by the Council on this item. <br /> <br />10, REPORTS OF THE CITY MANAGER <br /> <br />Item 10a <br />(1~ Amendment to Ground Lease. reauest to advance ZOne 7 water Connection fees~ and <br />allocation of funding to offset waiver of development fees; (SR94:213) <br /> <br /> Mr. Bocian presented the staff report. <br /> <br /> Mr. Pico preferred Option 3 in the staff recommendation. Although he believed that this <br />project should be considered after the General Plan Steering Committee went through its process, <br />but he did agree with the changes and recommendations staff has made. <br /> <br /> Ms. Mohr felt that Option 3 would allow the City to profit potentially from the rents. <br />She hoped that any proceeds beyond the investment of the City's land would be kept within the <br />program (lower rents or development for more lower income housing). <br /> <br /> Ms. Scribner agreed. She was concerned with Option 3 for fear that the rents would <br />increase in the future. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, to approve the amended <br />Ground Lease establishing revised ground lease rental payments consistent with Option 3 as <br />outlined in the staff report; to approve an amendment to Section 5, "Use of Land and Assurances <br />of Lessee", Subsection (h) , establishing the City' s right to approve the development refinancing; <br />to approve an allocation from the City's Lower Income Housing Fund of $738,062 to the <br />General Fund to offset the effect of the fee waiver; and to require the developer to repay <br />$61,420 to the City's Lower Income Housing Fund to reimburse the City for prepayment of <br />Zone 7 water connection fees. <br /> <br />06/21/94 9 <br /> <br /> <br />
