It was moved by Ms. Scribner, and seconded by Ms. Mohr, that Resolution No. 94-64 be <br />adopted, approving the Council Policies and Procedures, with the minor changes suggested by *- <br />Ms. Scribner. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />7. PUBLIC HEARINGS <br /> <br />Item 7a <br />In-Lieu Park Dedication Fees (SR94: 162) <br /> <br /> Ms. Acosta stated that Signature Properties had requested that this item be continued to <br />the next meeting. <br /> <br /> This item was continued to the June 21, 1994 City Council meeting. <br /> <br />Item 7b <br />PUD-91-19-1M, Peter Shutts/Jerrell Thomas (SR94: 181) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> In response to Mr. Pico, Mr. Swift referred to the overhead projection map and described <br />the location of this project. The Calavares Fault does not go through this property, but the <br />Fault zone does include some of this property. If Council were to approve staff <br />recommendation, staff would need to review the geological study. <br /> <br /> Mr. Pico inquired about the potential liability the City would have if the application were <br />denied. <br /> <br /> Mr. Roush did not feel that it would be any different for this project than for that of any <br />other project. <br /> <br /> Mr. Tarver declared the public hearing open on the application. <br /> <br /> Peter Shutts, 4133 Mohr Avenue, Suite G, Architect, represented Jerrell Thomas. He <br />was in agreement with the staff report and conditions of approval with the exception of <br />Condition No. 6. He requested that Condition No. 6 be eliminated and then explained the time <br />spent in negotiations to reach this point in the project.
