Mr. Tarver declared the public hearing open on the application. <br /> <br /> There being no testimony, Mr. Tarver declared the public hearing closed. <br /> <br /> It was moved by Ms. Dennis, and seconded by Ms. Scribner, that Ordinance No. 1626 <br /> be introduced, to be read by title only and waiving further reading thereof, creating provisions <br /> to amortize existing nonconforming uses. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 1Qa <br /> Review 0f GeolOgic COnditions - Golden Eagle Farm (SR94: 173) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Ms. Acosta suggested that if Council is interested in forming a committee to study <br /> alternatives, that the committee consist of an independent geologist, who has never been involved <br /> in this project, a few residents, staff, and perhaps a Councilmember. Council should indicate <br />- that the study recognize and consider the project as it exists today, not what could have been <br /> done six years ago. <br /> <br /> Ms. Mohr asked if it were possible to have the a geologist from the State participate in <br /> the process. <br /> <br /> Ms. Acosta answered yes and indicated she would contact Earl Hart. <br /> <br /> In response to Ms. Scribner, Mr. Swift explained who the original geologists were and <br /> their findings. <br /> <br /> George Reid, 596 Gerard Court, spoke about the landslide and earthquake faults along <br /> Foothill Road. He disagreed with the chief geologist on the project and believed that a new <br /> geological review was warranted. <br /> <br /> Jay Kamlani, owner of Lot 23, asked what recourse do the owners who have not built <br /> their homes have towards the developer. She requested a map that would show where the <br /> studies took place and where the fault lines are. She was also concerned with what she is <br /> required to disclose about the lot if she were to sell it. Ms. Kamlani also asked who would be <br /> responsible for the cost of additional studies. <br /> <br /> 05/17/94 5 <br /> <br /> <br />
