The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver --. <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 8e <br />Le_t, lslation Concerning Multi-AgenCy Agr~ments Affecting Regional Resources (SR94:83) <br /> <br /> Mayor Tarver presented a summary of the staff report. <br /> <br /> Mr. Roush clarified that the intent of this discussion was not to concede that the City had <br />acted illegally; it merely is to strengthen the authority of public agencies to enter into these kinds <br />of agreements. <br /> <br /> Frank Neu, 18210 Carreel Drive, presented a letter addressed to the Hayward City <br />Council that was requesting Hayward to withdraw from this MOU. He stated that Johan Klehs <br />has introduced legislation to solve this problem. He pointed out that the taxpayers of Pleasanton <br />would save money by withdrawing from the MOU. <br /> <br /> Larry Butler, 7325 Altura Place, Oakland, also spoke in opposition to the MOU. He <br />stated that the other property owners feel that this MOU is illegal. He listed the reasons they <br />are suing Pleasanton, Hayward and the County. <br /> <br /> Marie Cronin, 8989 Dublin Canyon Road, agreed with the previous speakers. She <br />believed that the MOU was unconstitutional and illegal. She believed Pleasanton should control <br />only what is within the city limits. <br /> <br /> Ms. Mohr asked for clarification on the staff recommendation. <br /> <br /> Mayor Tarver stated that the Attorney General' s opinion mentioned the lack of enabling <br />legislation. He would like to pursue such legislation. <br /> <br /> Mr. Pico reminded the audience and Council that in November, 1993 this matter went <br />to the voters of Pleasanton had approved general plan amendments for the Ridge. <br /> <br /> It was moved by Mr. Pico, and seconded by Ms. Dennis, authorizing staff to seek <br />legislation clarifying the authority of local agencies to enter into a cooperative multi-agency <br />agreement for regional planning. <br /> <br /> Ms. Mohr was unwilling to concede what she thought were Pleasanton's proper powers <br />to another jurisdiction.
