6. REPORTS OF THE CITY MANAGER

Item 6a
Adoption of 1993-94 Miseellane0us CIP PrOjeCts (SR94:09)

Ms. Rossi presented the staff report.

It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Resolution No. 94-02, be
adopted, approving the proposed Miscellaneous Capital Improvement Program Budget for the
1993-94 fiscal year.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mohr, Pie. o, Scribner and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

Item 6b
Status Report Re~,ardin_~ Pleasanton Railroad Pro_leer (SR94: 17)

Mr. Swift presented the staff report.

Ed Churka, Pleasanton Railroad Association founder, 507 St. John Street, believed that
an initial environmental study is not needed. (A slide presentation was given). He was
concerned with spending $30,000 on a study that has already been conducted. He was aware
of other traffic and impact studies conducted by the City and did not understand why these could
not be used. He claimed this project was exempt from CEQA requirements and referred to a
court decision on the Napa wine train.

Jack Lyon, 5250 Case Avenue, spoke about the effect that the potential noise from the
train's using the fight-of-way would have on those who live at Ridgeview Commons; he
requested a soundwall.

Robert Cordtz, 262 W. Angela, requested he be given access to the hazardous materials
reports filed by the Department of Transportation. He did not believe that the noise from the
whistles was an issue considering the mount of noise created by other trains coming through
Pleasanton.

In response to Mr. Pieo's concern, Mr. Roush explained that the statutory exemption is
not applicable to this situation because the tracks have been removed.

Ms. Mohr believed that the City staff should perform the scope of work for the
environmental study.

01104194 3
