It was moved by Mayor Tarvet, and seconded by Ms. Dennis, to revise the ordinance <br />to allow for designated smoking rooms only. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis and Mayor Tarvet <br />NOES: Councilmembers Mohr, Pico and Scfibner <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> A motion was made by Ms. Sefibner, and seconded by Mr. Pico, that Ordinance No. <br />1615 be introduced, to be read by title only and waiving further reading thereof, amending <br />Ordinance No. 1609 and Chapter 9.24 of the Pleasanton Code concerning smoking in public and <br />work places, with the following changes: 1) the definition of ubars~ is revised to include the <br />serving of food, or providing of music, dancing, pool tables, darts, etc., as incidental to serving <br />alcohol beverages; (2) a Designated Smoking Room is revised to mean a non work area where <br />no one, as part of his or her responsibilities, is required to enter at any time; (3) the definition <br />of Freestanding Bar is revised to mean a business which (a) primarily serves alcoholic <br />beverages, (b) as only incidental to serv~g such beverages, serves food, has music and/or <br />dancing, provides coin operated amusement devices, or provides pool tables, darts or other <br />similar activities, (e) prohibits persons under the age of 18 from entering the business, and (d) <br />was operating as a Freestanding Bar on January 1, 1994. (It will also have to meet the <br />ventilating requirements if there are other uses in the building. ); (4) the definition of ~restaurant~ <br />is revised to reflect that its primary purpose is the giving or offering for sale food to the public; <br />(5) if a single family residence is used at any time as a family day care home or health care <br />facility, smoking is prohibited at all times; and (6) smoking is not permitted in front of any place <br />of employment, not just the smoker's place of employment. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Pico and Scribner <br />NOES: Councilmember Dennis and Mayor Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item To <br />Ortlinanee Coneernin~ Access to Ci_~arettes and other Tobacco Produet~ (SP,94:07) <br /> <br /> Mr. Roush presented the staff report. <br /> <br /> Dan Stewart, 2137 Palmet Drive, 94588, owner of Amador Valley Vending, spoke in <br />opposition to changing the vending machine ordinance. <br /> <br /> Council did not wish to make any changes to this existing ordinance and therefore, no <br />action was taken by the Council on this item. <br /> <br />01/04/94 7 <br /> <br /> <br />
