The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> There was discussion about the timing of the grant application. Mr. Churka indicated <br />the TEA grant application was to be by December 4th, between March and April 1996, CTC <br />will be reviewing the application and by July 1, 1996 the grant should be awarded. <br /> <br />6. EXPANSION OF CITY PROGRAM TO ALLOW RESTAURANTS OUTSIDE <br /> DOWNTOWN TO FINANCE SEWER CONNECTION FEES (SR 95:383) <br /> <br /> Deborah Acosta presented the staff report. <br /> <br /> Ms. Dennis asked whether sewer capacity stays with the land or with the owner of the <br />individual business. It appears this is a situation where the occupant is buying the sewer <br />capacity for the landowner. <br /> <br /> Ms. Acosta stated that sometimes there might bca negotiated agreement between the <br />landlord and the tenant. <br /> <br /> Mr. Roush stated that if the tenant goes out of business, the property owner would be <br />contacted to see if the property owner wanted to continue to make the loan payments until the <br />loan is paid off. The sewage capacity would then remain with the property. If the payments <br />are not made, then the sewer capacity reverts to the City. <br /> <br /> Ms. Michelotti commented that Rod's Hickory Pit is moving because of the expansion <br />and asked what happened to that sewer capacity? <br /> <br /> Ms. Acosta stated the expectation is that it would be used on the Safeway property with <br />the expanded store. <br /> <br /> Ms. Michelotti then clarified that Rod's would need additional sewer capacity to take the <br />place of the capacity that stays at the old location.9 <br /> <br /> Jack Hovingh, 4250 Muirwood Drive, appreciated the questions asked by Council, which <br />clarified these issues. He was not in favor of the City behaving as a bank and felt that the City <br />needs to encourage local banks to do this son of business rather than the City doing it. He <br />hoped that coffee houses would be excluded from this and that the conditions would require <br />china, linen and real silver. He had envisioned that this might promote a destination restaurant, <br />similar to Wente's, with a well known chef coming to the City of Pleasanton.
