Mr. Tarver said we are trying to treat everyone the same and not giving anyone special <br />treatment. <br /> <br /> Ms. Michelotti preferred that the Liaison Committee be given a chance to talk with the <br />Fair Board with the message that has been heard from the property owners, which is different <br />from prior indications. Let the Liaison Committee hear out the other side and bring up the new <br />concerns. She doesn't want to force the Board to come back with a conditional use permit <br />application. <br /> <br /> Mr. Pico stated that the Council has received a letter from the Fair Board stating what <br />it feels is its legal position on this issue. He felt this might be the case to test the authority. <br />He felt whatever action is taken will result in litigation, because the Fair Board had clearly <br />indicated what its position is. The Board disagrees with the City being in control of what <br />happens on that property at all. He did not believe that the Fair Board will voluntarily comply <br />to any requests. If we want to send the Liaison Committee to ask them to comply one last time, <br />that is f'me with him. <br /> <br /> Ms. Dennis indicated she was hearing more than the light issue. She felt that the failure <br />to be them on the Fairgrounds is causing problems such as health concerns. She felt it is <br />Council 's job to protect the people who live in the City and she believed that the Fair Board <br />understands and respects that. Council is not saying it will deny every application of the Fair <br />Board. It is saying "please work with us because there are serious concerns that are <br />developing". Them are serious concerns and she hoped the Board would work with the Liaison <br />Committee to solve them. <br /> <br /> Ms. Acosta commented that it was a good idea to give the Fair Board a chance to <br />respond before taking action. Also Council had talked about a new process for major projects <br />when Council had its workshop. Whether to takB forward the land use fight with the <br />Fairgrounds was talked about and Council chose not to do that. It was not as high a priority as <br />all the other issues you were facing for the community. What was talked about, was first raising <br />the issue by the Liaison Committee with the Board and then secondly bringing back what would <br />be involved. <br /> <br /> Mayor Tarver stated that it was the intent of the motion that if the Liaison Committee <br />cannot get the Fair Board to comply voluntarily, then it would come back to Council as a <br />separate item. <br /> <br /> Mr. Roush stated that it doesn't have to be the Fair Board itself who is the applicant. <br />Normally the City would deal with the business. The City may not have to force the issue about <br />land use authority. The message can be one of telling the operator that there is a City process <br />that the operator needs to follow. It may have to be scheduled for a closed session so it can be <br />discussed what some of the options might be in terms of purSuing that. <br /> <br />11/28/95 -14- <br /> <br /> <br />
