Ms. Michelotti stated that this is a backyard to side lot configuration. She talked with <br />both neighbors who have come to a compromise. One of the considerations in making the <br />findings is that one house sits back 30-35 feet from the fence line. <br /> <br /> It was moved by Ms. Michelotti, and seconded by Ms. Mohr, that Resolution No. 95-120 <br />be adopted, upholding the appeal of a decision of the Planning Commission denying an <br />application for a variance from the Municipal Code to allow a carport which encroaches within <br />the required sideyard setback at 7254 South Valley Trails Drive. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Ms. Dennis stated she would like to have a more manageable approach regarding these <br />types of structures. <br /> <br /> Ms. Mohr commented that with this having been brought before Council in a one-on-one <br />situation, she felt that a more global approach needed to be looked at. When driving around <br />town, this kind of situation happens with a great deal of frequency and there needs to be a better <br />way of dealing with it. She recommended that Council direct staff to look at the situation and <br />present options on how to approach this with a more universal solution. <br /> <br /> Mayor Tarver commented he would look at options, but he did not want to legalize the <br />structures that are out there now. He felt there were good reasons for the code and the variance <br />process. If staff can come up with alternatives for permitting some of those structures to be <br />legitimate without damaging public health and safety and the aesthetics of the community, he <br />was in favor of it. <br /> <br /> Ms. Michelotti agreed with the Mayor and found it tough to grant variances. The <br />ordinances are there for good reason and thought the issue would probably come down to a case <br />by case basis. <br /> <br /> Mayor Tarver stated that there was consensus by Council to have staff look at options <br />to change the code and be more flexible on auxiliary structures. <br /> <br /> Mr. Sewell asked if he were now to meet with the building department. <br /> <br /> Ms. Michelotti replied that Mr. Smith will work with him regarding the conditions. On <br />condition five, she wanted clarification that it only applied to the fence line next to the structure. <br />Staff will work with Mr. Sewell to determine the measurement. <br /> <br />10/17/95 -7- <br /> <br /> <br />
