..... Pleasanton City Council is demanding that the capacity be purchased based on inflow capacity <br /> going to the treatment plant and not from outflow from the plant. He urged the Council to <br /> modify its previous position and look at buying true capacity, not paper capacity. <br /> <br /> Mayor Tarver stated that Council had not taken a position on influent or effluent. This <br /> Council had taken positions on proposals from EDBDA to LAVWMA and a counter-proposal <br /> from LAVWMA to EBDA. The voters of Pleasanton have the ultimate decision on the project. <br /> <br /> Mr. Berlogar urged the Council to buy capacity based on outflow from the plant and not <br /> inflow into the plant. <br /> <br /> f. Toys for Tots <br /> <br /> Bert Felix, 2860 Garden Creek Circle, commented that the Toys for Tots Drive will be <br /> beginning soon and he would like to get as many people involved as possible. Last year 500-600 <br /> toys were donated to give to children in the Tri-Valley area and he hopes to do as well this year. <br /> <br /> 6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br /> Item 6a <br /> AP-95-09 (Appeal of Case V-95-10) - Ken and Darlene Seweli <br /> Appeal of a decision by the Planning Commission to deny an application for a variance <br /> ....... from the Municipal Code to retain an existing carport which encroaches within the required <br /> three (3) foot side yard selback. (SR95:327) <br /> <br /> Brian Swift presented the staff report and the proposed compromise. <br /> <br /> Ms. Michelotti commented that in the compromise, the carport posts and the edge of the <br /> roof shall be sixteen inches from the closest point of the property line fence. The edge of the <br /> roof has a facia board on the outside of the posts. She felt the centerline of the posts would be <br /> the determining factor. <br /> <br /> Ms. Dennis asked if the sunset date for the structure would coincide with the ownership <br /> of the house, or would it relate more to the life of the structure. <br /> <br /> Mr. Swift suggested ways to allow the structure to be permanently located in that <br /> location. Any structure that currently sits in a sideyard setback illegally can be abated by the <br /> City now. The City doesn't have to wait until the home is sold in order for that to occur. Staff <br /> frequently get requests for variances when a house is sold because the owner's required to <br /> disclose then that it is a non-conforming structure. <br /> <br /> Mr. Tarver asked if any one wanted to comment.
