Item 6f <br />Request to process a General Plan Amendment for a 7.57+ acre parcel located between <br />Black Avenue and Hansen Drive (adjacent to Hansen Park) independent from the General <br />Plan Update. (SR95: 146) <br /> <br /> Mr. Swift delivered the Staff Report. <br /> <br /> Ms. Dennis asked about the CEQA process if the staff recommendations were followed. <br /> <br /> Mr. Swift stated that staff has not made a determination whether a negative declaration <br />or an EIR would be appropriate since staff doesn't have an application or project to review to <br />determine the environmental impacts. <br /> <br /> Ms. Michelotti asked if the proposed General Plan amendment would be processed at the <br />same time as the application for the project. She observed that since the School District controls <br />what is done with the property, it appears the District is at the mercy of the City regarding a <br />general plan change of the property. <br /> <br /> Mr. Swift stated that it is up to the applicant. The City Council has jurisdiction on what <br />land use goes on that property once the School District is no longer the owner. Right now the <br />General Plan allows either public or private school use on that site. <br /> <br /> Mr. Pico referred to the staff recommendation that there is no reason to refer this to the <br />General Plan Steering Committee because there is no reason to believe the Committee will <br />change its recommendation as to the site. The Committee has recommended leaving the existing <br />General Plan designation on the site which is for public institutions or schools. The vote was <br />unanimous. He also asked if the Planning Commission had reviewed this as well. <br /> <br /> Mr. Swift indicated the Planning Commission recommended the property remain for <br />public institutions or schools. <br /> <br /> Mayor Tarver asked for confirmation that state law allows the District to override the <br />zoning designation of the City for a proposed school site if it wanted to place a school on the <br />site. He asked if the School District can override the Council's determination in reverse, i.e., <br />where the District no longer wants to use the site for a school. <br /> <br /> Mr. Roush stated the District cannot override the zoning for a surplus school site. <br /> <br /> Mr. Fred Bates, 9781 Blue Larkspur Lane, Monterey, Principal with New Cities Business <br />Development Group, along with Pat Stringer, asked to be allowed to process the General Plan <br />amendment for the Del Prado site independent of the General Plan update. He requested the site <br />be given a zoning change to a PUD designation. He plans to build homes similar to the existing <br />neighborhood and wants the opportunity to present this plan to the Planning Commission and to <br /> <br />05/09/95 -6- <br /> <br /> <br />
