Mr. Bengtson indicated the current ordinance provides access a half hour before sunrise and a half hour after sunset. It does not speak to the fact that when there are sidewalks or lights in the park, that it is legal to use them. This proposed ordinance clarifies that. Some parks require special regulations. There was discussion about whether to separate the issues in the ordinance and it was determined not to separate the issues. It was moved by Mr. He, o, seconded by Ms. Dennis, to refer this proposed ordinance to the Park and Recreation Commission for review and recommendation. The Homeowners want to take responsibility for their decisions. He agreed if they do, then the City should not take responsibility for those decisions. The responsibility of making sure no landslides occur is on the homeowners and they take responsibility for any liability that may occur as a result of the City doing no further studies. 04/04/95 -21-
