Mr. Swirl indicated Condition 12 is interpreted so that the usual process is to <br />resolve any issues when possible at the staff level long before going to the Planning <br />Commission. <br /> <br /> Ms. Mohr observed that each time a day care facility has come before Council, <br />similar concerns are raised and conditions applied that provide for review in the event of <br />problems. None of these applications have had to come back for review because of <br />problems. That speaks well for the fact that once a facility is on notice that they are <br />being monitored, the operators are sensitive to concerns, and the neighbors' concerns go <br />away. The fact that this facility will care for toddlers should alleviate the concern that <br />there will be children wandering the neighborhood. The state law says that these kind <br />of homes are okay unless they prove to be a problem. That is like the principle "innocent <br />until proven guilty". There is not a lot of local discretion, but her experience has been <br />that this is not necessary. She wished the Phillips well and urged the Resources for <br />Family Development to continue its good work. She told the neighbors that if there is <br />any problem to call the Council and give the City a chance to resolve any difficulties. <br /> <br /> Mr. Tarver wanted the neighbors to know that Council is sympathetic with <br />neighborhood issues and wants to make sure the Phillips comply with the conditions. At <br />the same time, it is necessary to accommodate the need for day care. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Mohr, to adopt Resolution No. <br />95-33, denying the appeal and upholding the Planning Commission decision granting a <br />conditional use permit for a large family day care home located at 3444 Windsor Court. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br /> Mr. Pico was concerned about comments made about unclean facilities and asked <br />what the City's role is in reviewing these homes and how do people in the community <br />provide information about their concerns. <br /> <br /> Ms. Mohr felt those were probably unlicensed facilities and asked if the Resources <br />for Family Development representative was aware of the problem. <br /> <br /> Mr. Swirl indicated the State inspects day care facilities. <br /> <br />03/21/95 <br /> -8- <br /> <br /> <br />
