Jeffrey and Candy Phi!lips (Appellant; Marvyn Siders): Appeal <br />of the Planning COmmission decision approvin_~ a conditional use permit for a !ar_~e <br />family day care home (7-12 Children) at 3~.~?. Windsor Court. Zonin_~ for the <br />property is R-1-6.500 Single-family Residential District. (SR 95:88) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mr. Pico requested clarification on Conditions 9 and 10 regarding the hours of <br /> operation and outdoor activity. <br /> <br /> Ms. Mohr inquired whether the Planning Commission action was in response to <br /> an appeal of the Zoning Administrator's decision. Mr. Swift replied that it was and the <br /> Planning Commission added conditions to the approval. <br /> <br /> Mr. Tarver pointed out the conditions that state if there is any problem, the use <br /> can be brought back for review at any time and that a regularly scheduled review will <br /> take place in six months. <br /> <br /> Mayor Tarver declared the public heating open. <br /> <br /> Marvyn Siders, 343 1 Windsor Court, objected to the state government superseding <br /> regulation by local governments and neighborhoed CC&Rs. He referred to the conditions <br /> that allowed 10 children, which was changed by the Planning Commission to 12 children <br /> at the facility. Mr. Siders was concerned about an increase in traffic and did not feel the <br /> burden should be placed on the neighbors to prove this is not the right place for this <br /> facility. <br /> <br /> 03/21/95 <br /> -4- <br /> <br /> <br />
