strongly feels that the only way to resolve the doubts is to have independent people
review all the information.

Ms. Michelotti pointed out that flirther delays can only damage the residents.

Mr. Roesler related an exercise by his law school professor which indicated the
decisions of the Supreme Court could be predicted by their political affiliations and Mr.
Roesler believed that could be applied to this Council. He then quoted from a newspaper
article which indicated the City staff believed Golden Eagle was completely safe and
asked Council what evidence it had for opposing the staff conclusion. Mr. Roesler
contended the position was political and implied the matter would have to be settled in
court.

Ms. Mohr indicated she is the only one who has been on Council for the entire
process. Years ago the Walter Johnson Foundation proposed this project for development
and began the geologic reviews. This project has been before Council more than any
other project that involved hillsides and grading issues. She believes the City staff is
highly competent and has had every reason to do its job well, since it has been challenged
every step of the way on this. There were some nasty innuendoes in the press about the
staff and she was pleased the Herald printed a full page story retracting that and giving
credence to the staff.

She referred to the comment that Council was not listening and indicated there is
a distinction between hearing people and agreeing with people. Reasonable minds will
sometimes come to different conclusions. She was concerned about creating a panel of
geologists to review the prior work. Hindsight is 20/20 and she feels strongly that the
geologists will surely find something to prove they have done their jobs thoroughly. The
question is whether that finding will be substantial or not. She has followed this project
through the entire process and is convinced there is no problem. Ms. Mohr believes a
cloud has been created by the Council which must now be disclosed if the property is
sold.

She would support forming a committee to work for the next thirty days with
Golden Eagle representatives to determine what variation of a GHAD would work for the
residents; something that would guarantee that the V-ditches got checked every year and
other preventive maintenance jobs were done. The Twelve Oaks development had a
problem with drainage ditches that could have been prevented by early maintenance.

Her other concern was with the issue raised about dirt bikes on the hillside. She
suggested Dolores Bengtson investigate the matter.

03/07/95 - 15 -
