She did not think a lot of angry people demanding Council to <br />change its mind accomplished anything. <br /> <br /> Ms. Overbeck stated they were trying to get Council to listen to reason. She <br />believed enough professionals had already reviewed the situation. <br /> <br /> Mr. Springer offered his apologies to the homeowners and the subcommittee. He <br />indicated the Golden Eagle Board of Directors had appointed him as liaison with the City <br />on this issue and it had taken from June until December to collect independent geological <br />information so the Board could establish its position. That is the reason there were no <br />committee meetings. <br /> <br /> Ms. Acosta further explained that the original committee selected by the Council <br />was to have two Councilmembers, Earl Hart from the California Division of Mines and <br />Geology, and all the Golden Eagle homeowners. Staff suggested that, while all could <br />participate, one spokesman should be appointed for the homeowners to present the official <br />position of the association. That took some time to select because the association had an <br />election of new boardmembers. At the same time, staff was advised that Mr. Hart would <br />not participate in the process. So ahnost immediately, the committee was not what the <br />Council had envisioned. There has always been a willingness to work something out with <br />the homeowners. <br /> <br /> Ramsey Araj, 33482 Whimbrel Road, Fremont 94555, indicated this issue had <br />arisen in 1992 or 1993 and the City hired Peter Kaldveer and Associates to review the <br />findings of Mr. Levish because of concerns about his integrity. Mr. Araj also hired his <br />own geologist, Mike Merrill, to review the findings. Mr. Araj stated that Peter Kaldveer <br />looked at over a thousand feet of ditch, more than he believed Mr. Levish did. The <br />information has been reviewed, re-reviewed and re-re-reviewed. He felt Council had no <br />scientific evidence for taking its current position. Mr. Araj indicated he was on the sites <br />personally and monitored the work of Mr. Kaldveer. <br /> <br /> Mr. Lure indicated the City had retained a reviewing geologist, David Carpenter, <br />to go over Murray Levish's work. Harza Kaldveer Engineers were retained to monitor <br />the site's development to insure that all the recommendations were being followed. They <br />were not charged with reviewing Mr. Levish's work. Kaldveer was responsible for <br />determining if any faults, landslides, or instabilities became apparent during construction <br />and to ask for analysis where appropriate. <br /> <br /> Mr. Tarver indicated he had spoken to members of the geology community and <br />believed there was sufficient reason for reviewing the conclusions of Mr. Levish and he <br /> <br />03/07/95 14 - <br /> <br /> <br />
