Pico stated Council has worked with homeowners all along and has been willing to meet <br />at any time. <br /> <br /> Regarding the allegation of a de facto moratorium and loss of property value, Mr. <br />Pico stated there has never been a moratoriu~n, in fact eleven building permits have been <br />issued and there are seven lots currently tinder design review. He did not believe he or <br />the Council has ever tried to negatively impact the residents of Golden Eagle. <br /> <br /> Ms. Michelotti wanted clarification that a review of past reports would only be to <br />get background information, to see if anything else should be done, rather than reopening <br />and revisiting the conclusions to see if they were adequate. <br /> <br /> Ms. Acosta indicated that was staff's recommendation, but Council would <br />ultimately establish the scope of work if a committee were formed. <br /> <br /> Mr. Pico restated that his concern is whether the geologic hazards were adequately <br />addressed in the original PUD process and if not, what can we do about it today? He <br />hoped that everything was adequately addressed and that there are no issues that need to <br />be looked at. <br /> <br /> Mr. Tarver indicated he had opposed this project from the beginning. He had <br />asked staff to have independent reviews of the area before anyone bought lots or built <br />houses. He was sorry about all the trouble caused by the developer, by the debates over <br />house size and by the concerns raised by the resignation of the geologist. Council and <br />staff have tried for months to get everyone involved to work out a way that all interests <br />can be served so that the Council can say it has done everything in its power to insure <br />the safety of the homes and people tip there. <br /> <br /> There was discussion among Council and members of the audience about the <br />committee make-up and it was explained that only two Councihnembers could participate <br />because of the Brown Act requirements and that the delays were due to many factors. <br /> <br /> Ms. Overbeck believed that even if Mr. Levish was totally incompetent, there were <br />many other competent people who reviewed the project. She did not believe the opinion <br />of Mr. Reid was of importance as he was not part of the reviewing geologists. All this <br />delay is costing the residents of Golden Eagle a lot of money. <br /> <br /> Ms. Dennis indicated her concern that even though there was peer review of Mr. <br />Levish's conclusion, she felt there may have been some deference given to his opinions. <br />She would be more comfortable having a fresh panel of geologists review the material <br /> <br />03/07/95 13 - <br /> <br /> <br />
