competent and it believes the area is okay; 2) the residents are innocent people who have <br /> purchased property in reliance on City approvals and documentation; 3) this is a <br /> representative government elected by the people to carry out their wishes. He believed <br /> the matter has been reviewed again and again and at this point he felt Council was doing <br /> him harm. <br /> <br /> Ms. Dennis regretted that this ~natter has taken so long, however some of the delay <br /> was due to the request of the homeowners association to have more time to review <br /> documents and develop a position. She did not want to see the staff blamed entirely for <br /> the delay. She acknowledged that the Golden Eagle residents have had more than their <br /> share of difficulties. She pointed out that Mr. Levish was not called on the carpet for <br /> being controversial, but for negligence and incompetence. That is why she is concerned. <br /> Ms. Dennis believed the best way to resolve the issue is to have a panel of geologists <br /> review the situation, but she would consider a CHAD out of deference to the <br /> homeowners association. Simply stopping further inquiries will not remove the cloud on <br /> this area. She understood why some people feel Council is acting from political <br /> motivations, but disagreed that was accurate, particularly with regard to her own <br /> concerns. <br /> <br /> Ms. Michelotti presented her background, citing where she lived and her service <br />_ on the Planning Commission. She indicated the City Council has always had the best <br /> interests of the City of Pleasanton in mind. She referred to the comments about the <br /> incompetence of Mr. Levish, but countered by stating the City staff is very competent and <br /> thorough and has used every means to protect the interests of the residents. She has <br /> complete faith in their conclusions and would prefer to end this matter here. She wanted <br /> to make it clear that she was not taking this position because of the number of angry <br /> people in attendance. She has had to make decisions contrary to what angry people <br /> wanted. <br /> <br /> Ms. Michelotti supported the suggestion of Mr. Wendt that some kind of <br /> assessment fund be established by the homeowners association to accomplish the purposes <br /> of a geologic hazard abatement district. She also encouraged full disclosure of this matter <br /> and all relevant documents to fi~ture buyers of Golden Eagle property. <br /> <br /> Mr. Pico echoed the comments of Ms. Dennis and shared the concerns of Ms. <br /> Michelotti that this matter be concluded. However, he did not believe the matter could <br /> be concluded without having a committee of independent geologists review the process <br /> to this point. He felt there were legitimate questions about the integrity of the principal <br /> geologist. Mr. Pico mentioned that two local newspapers had reviewed this issue and <br /> came up with totally different opinions as to the information.
