I__ ..- It was moved by Ms. Dennis, seconded by Ms. Mohr, that the City not purchase the <br /> property. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers - Dennis, Michelotti, and Mohr <br /> NOES: Councilmember Pico and Tarvet <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 6b <br /> City Rek-ulationS Governin~ Parking of Vehicles in Residential Areas (SR 94:394) <br /> <br /> Ms. Acosta presented the staff report. <br /> <br /> Ms. Mohr indicated the cities of Salinas and Fremont have enacted ordinances regarding <br /> recreational vehicles and the Salinas ordinance is being challenged. If Council has interest in <br /> exploring the issue further, she suggested waiting until the court decides on the Salinas issue. <br /> <br /> Merilynne O'Brien, 1098 Touriga Place, indicated the challenge to the Salinas involved <br /> posting notice to prohibit parking of RVs. She stated there is case law and statutory law that <br /> upholds restrictive parking by the city. She indicated she could provide citations to the City <br /> Attorney when he returns. She is a paralegal and has done extensive research on the issue. <br /> <br /> Mrs. O'Brien then described the problems over the past four years caused by a 22' <br /> recreational vehicle parked in front of her home. She cannot see out her front window to the <br /> street. She has asked the owner to move the vehicle on numerous occasions and all requests <br /> have been ignored or rebuffed. The RV has not been moved for street sweeping or street repair. <br /> She also complained the rear wheels of the vehicle were on the sidewalk and interfered with use <br /> of the sidewalk. She then referred to a period when the house on the corner was for sale and <br /> the real estate agent asked that the RV be moved ro eliminate an eyesore which could devalue <br /> the property. The RV owner moved the vehicle only once for a couple of hours. <br /> <br /> Mrs. O'Brien stated the real issue before Council is not her personal problem, but the <br /> fact that the Municipal Code does not provide adequate regulation. Owners simply move their <br /> vehicles every 72 hours and the clock starts ticking again. She was concerned that emergency <br /> vehicles could not gain access to her home because of the RV in front. She does not believe <br /> residents should be denied the quiet enjoyment of their property because of these problems. Ms. <br /> O'Brien indicated neighboring cities have enactea' ordinances regulating RV storage on city <br /> streets (Salinas, Fremont, Dublin, San Ramon, San Francisco, Alamo, and Danville). She <br /> requested that Council adopt a similar ordinance. Ms. O'Brien cited Vehicle Code 22507 which <br /> empowers local authorities upon posting notice to prohibit or restrict parking or standing of <br /> vehicles, including but not limited to vehicles more than six feet in height.
