Mayor Tarver said unless staff changes its mind he had two weeks to move from the site.

Mr. Pico felt two weeks was not long enough. He proposed giving Mr. Morgan 180 days to
move from the site. He said there is no plan for anyone to move immediately onto the site. He said
it would be difficult for Mr. Morgan to try and move within two weeks. He said the RV storage
place would be a good place to store the trailers if he can get approval.

Ms. Michelotti said it is difficult to make the findings when a plan has not been submitted.
She would entertain a longer period of time. She did not want to put anyone out of business. She
would like staff to explain the steps Mr. Morgan needed to go through in order to comply.

Mr. Swift said a building has to be approved through a conditional use permit process.

Mayor Tarver said there has been plenty of dialogue between the applicant and the City. He
understood the applicant has done everything he can to correct the problem. But he wished during
the first appeal the applicant had decided to go for a permanent fix instead of going through the
appeal process. He agreed that two weeks was not a reasonable enough time to vacate the property.
He said if there is no location within the City of Pleasanton where he could get a conditional use
permit for this storage, he would like staff to consider this. He could not make the findings
required to give the applicant an extension.

-- Mr. Morgan asked what is acceptable at the site.
Mayor Tarver said he did not want to discuss the issue any further.

Ms. Dennis was concerned with the 180 days. She agreed that two weeks was not long
enough, but that 180 days was too long. She felt Council should require a site closure plan to be
given to the City within 45 days and based on that plan determine the number of days for the
applicant to vacate the property. She had a concern that the applicant would not move within the
specified time frame.

Mayor Tarver made a motion, seconded by Ms. Dennis, requiring the applicant to
submit within 45 days a site closure plan to the Planning Department and then to allow
another 45 days for the applicant to execute the plan and vacate the property.
The roll call vote was as follows:
AYES: CouncilmembersAyala, Dennis, Michelotti, Pico, and Mayor Tarver.
NOES: None.
ABSENT: None.
ABSTAIN: None.

Pleasanton City Council 24 04/6/99
Minutes
