Ms. Michelotti asked what are the options in consideration of the requests made tonight,
which were to keep the medical use on the property, remove the party rental use, and refer the
building design back to the Planning Commission but approve the conditional use permit for the
party rentals.

Mr. Swift said the applicant is asking for a conditional use permit for twelve months that
would apply to the medical rent facilities, all the outdoor storage and trailers. The party rental
material would be removed. The design of the site would be referred to the Planning Commission
to review a permanent building for the use and at that time would also be taking out a permanent
use permit application that would allow the full range of uses that would fit into that permanent
structure. He said staffs recommendation is to deny the pending application. Staff feels that the
use has been on the site long enough without approval and should be moved somewhere else until
approval for the use can be obtained. The applicant is free to file an application for a permanent
building.

Ms. Michelotti asked if the medical use was a permitted use on the site.

Mr. Swift said the medical rentals are a permitted use. The conditional use permit is for the
outdoor storage and temporary containers on site.

Ms. Acosta clarified that the fire department was not comfortable with the oxygen being
stored on site.

It was moved by Ms. Dennis, seconded by Ms. Ayala, to adopt Resolution No. 99-044,
denying the appeal (Case AP-99-01) and thereby upholding the decision of the Planning
Commission to deny the application of Peter Shutts/Russ Morgan, as filed under Case UP-98-
37/Z-98-176.
The roll call vote was as follows:
AYES: Councilmembers Ayala, Dennis, Michelotti, Pico, and Mayor Tarver.
NOES: None.
ABSENT: None.
ABSTAIN: None.

Mr. Swift said the use would have to be removed from the site within two weeks.

Ms. Michelotti made a motion that the applicant or owner paint the present house.
The motion died for a lack of second.

Mr. Morgan asked where he would go from here. He said there is no other location in
Pleasanton to move to. He has tried to comply. He has no other options.

Pleasanton City Council 23 04/6/99
Minutes
