Ms. Michelotti asked what are the options in consideration of the requests made tonight, <br />which were to keep the medical use on the property, remove the party rental use, and refer the <br />building design back to the Planning Commission but approve the conditional use permit for the <br />party rentals. <br /> <br /> Mr. Swift said the applicant is asking for a conditional use permit for twelve months that <br />would apply to the medical rent facilities, all the outdoor storage and trailers. The party rental <br />material would be removed. The design of the site would be referred to the Planning Commission <br />to review a permanent building for the use and at that time would also be taking out a permanent <br />use permit application that would allow the full range of uses that would fit into that permanent <br />structure. He said staffs recommendation is to deny the pending application. Staff feels that the <br />use has been on the site long enough without approval and should be moved somewhere else until <br />approval for the use can be obtained. The applicant is free to file an application for a permanent <br />building. <br /> <br /> Ms. Michelotti asked if the medical use was a permitted use on the site. <br /> <br /> Mr. Swift said the medical rentals are a permitted use. The conditional use permit is for the <br />outdoor storage and temporary containers on site. <br /> <br /> Ms. Acosta clarified that the fire department was not comfortable with the oxygen being <br />stored on site. <br /> <br /> It was moved by Ms. Dennis, seconded by Ms. Ayala, to adopt Resolution No. 99-044, <br />denying the appeal (Case AP-99-01) and thereby upholding the decision of the Planning <br />Commission to deny the application of Peter Shutts/Russ Morgan, as filed under Case UP-98- <br />37/Z-98-176. <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala, Dennis, Michelotti, Pico, and Mayor Tarver. <br />NOES: None. <br />ABSENT: None. <br />ABSTAIN: None. <br /> <br /> Mr. Swift said the use would have to be removed from the site within two weeks. <br /> <br /> Ms. Michelotti made a motion that the applicant or owner paint the present house. <br /> The motion died for a lack of second. <br /> <br /> Mr. Morgan asked where he would go from here.
