His <br /> concem is with the window treatments. He said the window treatments that currently exist are not <br /> as appealing as they could be and that they should be changed to a more traditional design. He said <br /> the reason staff recommended denying the appeal is because the windows are already in place. On <br /> another note he would like a bond required to help expedite the completion of the project. <br /> <br /> Mr. Roush said generally bonds are required for the public portion of residential projects or <br /> for public improvements on commercial projects that exceed $50,000, but not for private work on <br /> private property. <br /> <br /> Diane Churka, 507 St. John Street, said the Churka's asked permission and the windows <br /> were approved. She indicated that the windows they picked are metal windows and they were <br /> approved. After the windows were up for over a year she received a letter from the Planning <br /> Department stating that the windows did not look like what staff thought they were going to look <br /> like. She did not understand why it took so long for the Planning Department to respond. She also <br /> has been told that they cannot have occupancy until the window trim is widened. This would cause <br /> a major delay because there are 65 windows to replace. She resented Mr. Hovingh's appeal. The <br /> difference in the trim is 1¼ inches. She challenged anyone to drive by and see if the 1¼ inches <br /> make a difference. She reiterated that they got approval for the windows. She mentioned that she <br /> was not invited to the Downtown Association meeting where people commented on the windows. <br /> <br />---- Ms. Michelotti asked if she understood that she was also to address the height of the fence. <br /> <br /> Ms. Churka did not want to put a gate in the fence. The building sits on a busy comer, and <br /> for liability reasons they would like the area secured. <br /> <br /> Ms. Michelotti did not want the fence eliminated either, just shorter in height. <br /> <br /> Ed Churka, 507 Saint John Street, showed a sample of the window that had been installed. <br /> He said it is the same window that the Planning Department approved. He explained the plans for <br /> the window frame. He did not like that process, so he went with a window that had quite a bit more <br /> design and that has an open awning on the top for fresh air. He believed that Jack Hovingh's <br /> appeal is for the width of the window. The other two issues have not been challenged. <br /> <br /> Mayor Tarver clad fled that once an appeal is filed, all the issues are open for discussion. <br /> <br /> Mr. Churka said the original plan was for a 3000 sq.ft. building, single story old time <br /> residential looking building. This plan was rejected by the Planning Department. The Planning <br /> Department wanted a two-story building similar to other buildings in the area.
