confer with legal counsel regarding potential litigation against Alameda County regarding
the County's approval of the EIR and use permit for the AItamont Landfall.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

4. Review of Chamber of Commerce Request for Sponsorship of Installation Function in
January_ (SR 96:362)

A1 Amador, Executive Director of the Chamber of Commerce, briefly reviewed some
of the joint accomplishments of the City and the Chamber, e.g. a website, meeting room index
for the City, and other economic development projects. He indicated the 1997 installation
function will be the kickoff for community activities and hoped the City would sponsor a portion
of the function.

Ms. Ayala asked if the requested $1,000 could be redirected to other, more progressive
business applications.

Mr. Amador stated there is a range of projects during the year, such as the
telecommunications showcase or contract procurement, which could benefit from the City
funding. However, the intent of the Chamber was to have a statement of support from the City
to kickoff the year.

Ms. Michelotti referred to the Board retreat and expressed appreciation for being allowed
to participate in the dialogue. She hoped a similar event could be hosted by the City Council.

Ms. Dennis supported the sponsorship of the installation dinner and but felt future
applications for sponsorship of events should be by way of application for a grant along with
other nonprofit organizations.

It was moved by Mr. Pico, seconded by Ms. Dennis, to approve sponsorship of the
Chamber of Commerce installation dinner by appropriating $1,000 for the event.

Jack Hovingh, 4250 Muirwood Drive, objected to the City sponsoring a social event of
the Chamber of Commerce. He felt it was precedent setting. He agreed there should be
cooperation between the City and the Chamber, but felt the installation dinner was not a good
use of public funds.

2 12/19/96
