MINUTES OF THE SPECIAL MEETING <br /> OF THE <br /> CITY COUNCIL <br /> <br /> December 19, 1996 <br /> <br />CLOSED SESSION - 6:15 P.M. <br /> <br /> Council convened in Closed Session to confer with legal counsel regarding potential <br />litigation against DERWA concerning its certification of an EIR and approval of a recycled <br />water project; this matter was continued to after the workshop. <br /> <br />1. CALL TO ORDER <br /> Mayor Ben Tarver called the Special Meeting of the City Council to order at 7:13 p.m. <br /> <br />2. ROLL CALL <br /> <br /> City Clerk Peggy L. Ezidro called the roll, which is recorded as follows: <br />Councilmembers present were Kay Ayala, Becky Dennis, Sharrell Michelotti, Thomas P. Pico, <br />Jr. and Mayor Ben Tarver. Staff members present were: Deborah Acosta, City Manager; <br />Michael H. Roush, City Attorney; Brian W. Swift, Director of Planning and Community <br />Development; and Bill van Gelder, Traffic Engineer. <br /> <br />3. MEETING OPEN TO THE PUBLIC <br /> <br /> There were no speakers. <br /> <br /> Mayor Tarver requested a closed session at the end of the meeting to consider joining <br />with Livermore in a potential lawsuit regarding the Altamont Land fill. <br /> <br /> Mr. Roush stated that in order to add that item, Council must f'md that the matter arose <br />after the agenda was posted and the action was necessary because Council would not meet again <br />until after the timeline for action had passed. <br /> <br /> It was moved by Ms. Dennis, seconded by Mr. Pico, to make the rmdlng that the <br />County's approval of an EIR and a use permit for the expansion of the Altamont Landfill <br />arose after the agenda was posted and action is necessary prior to the next regularly <br />scheduled Council meeting; and to adopt Resolution No. 96--147 adding a Closed Session to <br /> <br /> 1 12/19/96 <br /> <br /> <br />
