Mr. Tarver inquired about the permitting process for the hot dog carts. <br /> <br /> Mr. Swift said an ordinance would have to be drafted for Council review. Staff believed <br />a simple design review approval would be sufficient, whether by the Zoning Administrator or <br />the Planning Commission. Council can determine whether it wants the use to be a conditional <br />use, administrative conditional use, design review only or whatever. <br /> <br /> Ms. Dennis was not in support of the hot dog carts because there are already several fast <br />foot restaurants near retail areas and she was concemed there would be too many of these cans <br />in town. <br /> <br /> Mr. Tarver suggested removing recommendation//4 from the motion. <br /> <br /> It was moved by Ms. Mohr, seconded by Ms. Michelotti, to introduce Ordinance No. <br />1697, to be read by title only and waiving further reading thereof, approving staff <br />recommendations 1, 2, 3, 5, and 7, with direction to review whether sidewalk entertainment <br />might be appropriate for special occasions or on Friday or Saturday even|rig downtown. <br /> <br />The r011 call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Mohr, as to recommendation//4, <br />that staff draft an ordinance establishing a permit process for hot dog cam, espresso <br />stands, etc. on private property when the property owner and/or shopping center manager <br />agrees and regulating the number of such businesses. <br /> <br /> Ms. Dennis expressed concern about what agency would control public health issues <br />where the sale of food is involved. <br /> <br /> Ms. Acosta indicated Alameda County is the regulating agency, and Pleasanton's Code <br />Enforcement Officer would contact the County. Ms. Acosta also suggested having neighboring <br />business approve such uses. <br /> <br /> Mr. Pico was not in favor of having hot dog carts all around the city. He felt there were <br />sufficient fast food establishments and did not feel there was a big demand for this. <br /> <br /> Mr. Tarver felt the staff could draft an ordinance that would adequately control the use, <br />but still allow the use in logical areas such as Home Depot. <br /> <br /> 6 10/01/96 <br /> <br /> <br />
