Also ConSider the Neaative Declaration prepared for the pr~ect. <br /> Jerry Iserson presented the staff report. <br /> <br /> Ms. Mohr asked staff if the 1.66 acres is the developable acreage based on the new <br />General Plan. <br /> <br /> Staff advised that the 1.66 acres was based on the former General Plan but the current <br />General Plan calls for 1.43 acres. <br /> <br /> Mr. Tarver asked if this project had the standard growth management condition stating <br />that if it doesn't get growth management in two years, it has to go through the approval process <br />again. <br /> <br /> Mr. Iserson said yes. <br /> <br /> Mr. Pico asked whether the applicant will construct and do improvements to the trail. <br /> <br /> Mr. Iserson indicated yes. <br /> <br /> Mr. Pico continued that the City is not getting any amenity other than the construction <br />of the trail. <br /> <br /> Mr. Iserson indicated the total estimate for the trail construction and repair is <br />approximately $30,000. <br /> <br /> Mr. Pico then inquired that for a $30,000 improvement, the applicant is seeking the <br />maximum of the MDR range. <br /> <br /> Mr. Iserson advised that is what staff is recommending for approval. <br /> <br /> Mr. Pico commented that this area has been inundated in the past with heavy storm <br />runoff and he inquired how the applicants anticipate protecting this from happening in the future. <br /> <br /> Mr. Iserson felt that the paving will greatly protect the trail, much more than the existing <br />gravel and dirt surface. The remediation required will protect the roadway. <br /> <br /> Ms. Acosta added that there are discussions with Zone 7 to get the obstructions <br />downstream removed as well as staff's working with Zone 7 to reduce the amount of water <br />released in the arroyo. <br /> <br /> In response to Mr. Pico, Mr. Roush commented on the problem of enforcing conditions <br />through a Homeowners Association. <br /> <br />08/20/96 -13- <br /> <br /> <br />
