Ms. Dennis indicated she was very impressed with the way the City' s Code Enforcement <br />Officers operate today. In the majority of cases, the current process is sufficient, however she <br />realizes that in some cases stronger tools of enforcement are needed. We have not had those <br />tools until now. <br /> <br /> Mr. Tarver related an incident that took two years to resolve by using the existing <br />methods. He felt it necessary for staff to have a mechanism to get the attention of a person in <br />violation of a City code and that is usually a financial incentive. <br /> <br /> Mayor Tarver declared the public heating open. <br /> <br /> There being no testimony, the public hearing was closed. <br /> <br /> It was moved by Ms. Dennis, seconded by Ms. Michelotti, to introduce Ordinance <br />No. 1687, to be read by title only and waiving further reading thereof, to amend Section <br />1.12.010 of the Pleasanton Municipal Code and to add Chapters 1.24 and 1.28 to the <br />Pleasanton Municipal Code providing for administrative citations and administrative <br />remedies. <br /> <br /> Mr. Pico was concerned about the requirement that the fine be deposited in advance. <br /> <br /> Mr. Roush indicated that is the way the parking citations are processed. If a person <br />appeals a citation, the fine is deposited, then if the hearing officer finds in the person's favor, <br />the amount of the deposit is returned. <br /> <br /> Ms. Michelotti indicated that process is followed in other jurisdictions as well. <br /> <br /> Mr. Pico felt that would create an obstacle to people's willingness to participate in this <br />process. <br /> <br /> Mr. Roush indicated there is a provision for a person with financial hardship to seek an <br />exemption from making the deposit. <br /> <br /> Ms. Michelotti indicated that many residents comply after the first waming, however <br />there are others who require further motivation. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers- Dennis, Michelotti, Mohr, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />07/16/96 -12- <br /> <br /> <br />
