It was moved by Ms. Michelotti, seconded by Ms. Dennis, to introduce Ordinance
No. 1686, to be read by title only and waiving further reading thereof, to modify the
Development Agreement for the Bernai Corporate Park to extend the term by seven years
from October 1, 1998 to October 1, 2005.

Mr. Tarver was opposed to this because he felt too much was given away to get the park
fees and he had reservations about the left turn. Extending the agreement itself would have been
all right with him.

The roll call vote was as follows:
AYES: Councilmembers- Dennis, Micheloff, Mohr, and Pico
NOES: Mayor Tarvet
ABSENT: None
ABSTAIN: None

Item 6e
Review of Bids ltml Award of CQntract for Legal Publications. (SR96:207)

Steven Bocian presented the staff report.

Ms. Dennis asked how many days a legal ad is run? Is the circulation area of concern?

Mr. Bocian indicated legal ads are typically run for a single day. The circulation number
and area are not of critical importance. This was reviewed a number of years ago and it was
determined that the most important aspect is whether the citizens of Pleasanton are adequately
informed. Staff did have concern about how widely read was "The Independent" and how
available it was to the general public.

Ms. Acosta referred to a letter received from "The Independent" regarding some
additional points.

Mr. Pico indicated the City of Livermore had used "The Independent" for its legal
notices. Has staff contacted Livermore to see how that worked?

Mr. Bocian indicated the City Clerk had contacted Livermore and the Livermore staff
indicated it has been satisfied with the service. He pointed out that the City of Livermore is
generally not as proactive as Pleasanton in terms of major advertisements for hearings.

Mr. Pico understood the feelings of staff, but he was concerned that when ads are placed
in the Sunday Times they would be overlooked because of the large number of pages and
sections. He felt ads would be more readily visible in "The Independent" due to the size of the
papor. He wanted as broad coverage of these special meetings as possible. He realized there
may have to be legal notices on certain days. He wanted more flexibility in the public notice

07/09/96 -13-
