The r011 call vote was as follows:
AYES: Councilmembers - Dennis, Michelotti, Pico, and Mayor Tarver
NOES: Councilmember Mohr
ABSENT: None
ABSTAIN: None

Item 6d
Ext¢~ign of Bernal Corporate Park Development Agreement. (SR96: 190)

Brian Swift presented the staff report.

Mr. Tarvet asked if there were other provisions coming along or does this provision get
the park fees.

Mr. Swift stated the park fees are already paid. This is the last thing he is aware of.
Mayor Tarver declared the public hearing open.

Jim Gresham 711 Koll Center Parkway, representing Bernal Corporate Park, indicated
he was in agreement with the staff report and was available to answer questions.

Mr. Tarvet recalled there were a number of requests, including the left turn into the
business park, sewer reservation extension, and terms of the agreement extended. Were all
those included in this request.

Mr. Swift indicated the sewer issues were resolved in a previous contract which also
included a mechanism to pay the park fees for the existing property and future development
within the business park. That agreement has now been executed. The left turn item is a
separate issue that will ultimately be before Council for review. The traffic engineering division
is currently working on that. There was also a request of city staff to combine that traffic light
with the signalization of the northbound off ramp at 680/Bernal.

Mr. Gresham felt the previous agreement covered all those items and this extension is
the only remaining issue.

Ms. Acosta indicated there was some question about the left turn signalization but the
agreement would be reviewed.

There being no further testimony, the public hearing was closed.

07/09/96 -12-
