Mr. Pico felt the growth management process h~! become a mockery with the
carryovers. He would not support the motion and felt Council should have more courage.

Ms. Michelotti referred to the figures for projected units and the actual permits. She felt
Council was criticizing a growth management program that was approved by it. Over that last
fifteen years, the growth mmmgement programs have been ~ltered many times. It seems Council
is trying to accommodate the projects that are ready to build. The present growth management
plan is trying to get rid of the speculation. She felt the reality was that the projected numbers
for units to be built was far lower than the projected figures.

The roll call vote was as follows:
AYES: Councilmembers - Dennis, Michelotti, Mohr, and Mayor Tarper
NOES: Councilmember Pico
ABSENT: None
ABSTAIN: None

Item 6c
Application 9f Y¢IIgw TOp Taxi Cab Company to conduct business in Pleasanton. (3R96:49)

-- Chief William Fastman presented the staff report.
Mayor Tarver declared the public hearing open.
Dean A. Nadem, the applicant, was available to answer any questions.

Loma Boatwright, 22547 Wailtin, Hayward, indicated she had represented St. Mim~
a year ago for an application to operate in Pleasanton. She felt there was not a demand for
another cab company. From a distance the yellow top cab looks like a yellow cab. She referred
to the Tri-Valley Yellow Pages and the ad for Yellow Cab, which she felt was misrepresenting
the applicant.

Reza Ghorbani, 3596-B Utah Street, indicated he had started a cab company in San
Ramon under the name of Yellow Cab. Later he expanded his service to Pleasanton and because
there was a company using the name Yellow Cab, he was required to change his name to Tri-
Valley Cab Company and the color of his cab. Two years later, lVh-. Overby went out of
business and Mr. Ghorbani then requested and received permission to go back to Yellow Cab
and to repaint his cabs. He has a reputation in the community as Yellow Cab and objected to
the use of Yellow in the name of the applicant. He felt it would create confusion to his
customers. lVlr. Ghorbani did not believe there was enough business to justify another taxi
company in this community. If there was, he could put more cabs in service.

Ms. lVlichelotti requested clarification on the name change issue.

02/20/96 -10-
