Ms. Dennis appreciated Mr. Kaplan's input, but did not feel the community shared his <br />point of view. She said the community is very concerned about liquor stores in the <br />neighborhoods and would like them to fall under the conditional use permit procedure. <br /> <br /> Ms. Ayala welcomed all new businesses and said Pleasanton has nice people that would <br />use Mr. Kaplan's stores. <br /> <br /> It was moved by Ms. Dennis, and seconded by Ms. Ayala, that Ordinance No. 1725 <br />be introduced, to be read by title only, and waiving further reading thereof, amending <br />Chapter 18.44 of the Pleasanton Municipal Code to make liquor stores conditional uses in <br />the Neighborhood Commercial and Central Commercial Districts. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Pico and Mayor Tarver. <br />NOES: None <br />ABSENT: Councilmember Michelotti <br />ABSTAIN: None <br /> <br />Item 6c <br />Appeal by Mr. Steve Camplsi of the decision by the Public Works Director denying <br />_oermi~ion for removal of a Heritage Tree at 4909 Foresthill Drive. (SR97:294) <br /> <br /> Randall Lum presented the staff report. <br /> <br /> Mayor Tarver asked when the revisions to the Tree Heritage Ordinance would be done. <br /> <br /> Mr. Lum said there has been a long delay to bring back some of the changes Council <br />authorized. He hope to bring it back later this year. One of the reasons for the continued delay <br />is that staff is looking at options which were not brought to Council previously. <br /> <br /> Mayor Tarver asked how old the tree was? <br /> <br /> Mr. Lum said approximately 25 years old. This species of tree is known to live <br />approximately 100 years. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Steve Campisi, 4909 Foresthill Drive, said he was here to seek permission to remove the <br />heritage tree (palm tree) on his property. He was offended at the down play (in the staff report) <br />of the concrete damage. There is a half inch gap in the middle of the concrete. The tree is <br />causing more damage as time goes on. The tree is positioned on the corner, which is subject <br />to constant winds. Approximately 50 limbs came down one day from the winds. He was <br />informed by staff on how to prune the tree.
