Ms. Acosta said the numbers now are not as clear as they could be. Whatever option
Council chooses will cost the City money. The study was done to determine what kind of
library Council wanted for Pleasanton and the best partner for the future.

Mr. Pico said in looking at the schedule a further report would be presented on
December 16. He would like to avoid major issues during the holidays.

Mayor Tarver said if the City wanted to do something it needed to be done by
December 31. The intent can be withdrawn in 1998 if the City changes it mind.

Mr. Bocian said the City was not trying to force the issue but because of procedural
issues, the County needed to be notified by December 31, 1997, if the City intended to
withdraw.

Mr. Pico asked the Library Commissioners to stand so they could be recognized.
(The Library Commissioners present stood.)

Item 6b
RZ-97-05. Cit_v of Pleasanton
AOplication to consider an amendment to Chapter 18.44 of the Pleasanton Municipal Code
(Commercial Districts) to make Hquor stores conditionally permitted uses in the
Neiahborhood Commercial and Central Commercial DiStrictS. (SR97:281)

Brian Swift presented the staff report.

Mayor Tarver declared the public hearing open.

Don Kaplan, 634 Blue Spruce Drive, Danville, said the City has stated that if it has had
no problem with convenience stores, liquor stores, or supermarkets and therefore if zoning is
permitted for a particular site for this kind of use, then a conditional use permit is unnecessary.
Rather than include liquor stores with convenience stores, the City ought to consider taking
convenience stores and supermarkets that sell legal products and are responsible retailers out of
the conditional use process. Liquor and cigarettes are legal products and if people do not want
them sold they should make them illegal. He mentioned the problems occur if a store sells
liquor to minors. Right now if an existing store wanted to enlarge it must apply for a
conditional use permit. He felt this would affect independent supermarkets. He wished Council
would not adopt this ordinance.

There being no further speakers, the public hearing was closed.

Pleasanton City Council 10/07/97
Minutes 7
