Ms. Michelotti asked if by making membership in the Association a requirement, would <br />the homeowner be subject to the same setbacks required for the project? She did not want to <br />eliminate the access off Foothill Road unless the homeowner wanted it. <br /> <br /> Mr. Swift said the condition required the homeowner to apply, but if the homeowner did <br />not use certain facilities, the homeowner would not have to pay for those facilities. The setback <br />would be 120 feet if the homeowner joined the Association. The conditions leave an option open <br />for a potential buyer to have a garage off Golden Eagle Way. The existing driveway and <br />parking areas directly behind the house will be eliminated and landscaping will be put in. <br /> <br /> There was a break at 9:30 p.m. <br /> <br /> The meeting reconvened at 9:40 p.m. <br /> <br />Item 6c <br />A_~n'eement between Alameda County and City of Pleasanton for !and use protOCols for the <br />Alameda County Fairgrounds (SR97:280) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Michael Roush also gave a brief report on the agreement. <br /> <br /> Mr. Pico expressed his concern with two items in the agreement: Historical Uses of the <br />Fairgrounds, Number la and lc. He did not agree with Alameda County having sole <br />jurisdiction over the Fairgrounds regarding horseracing issues. He felt this could allow the Fair <br />Board to include Bay Meadows facilities. <br /> <br /> Mr. Roush said the Fairgrounds is presently used year round to train and stable horses. <br />The intent of the agreement is that such use would continue as is. If the historical use were to <br />change dramatically, then the agreement reserves the right for the City to contest that change. <br /> <br /> Mayor Tarver asked where was Exhibit A that is referenced in the Agreement. <br /> <br /> Mr. Roush said Exhibit A was an item that was discussed with the County in terms of <br />interim events. He thought that agreement had not been reached as to what should be in the <br />Exhibit A and therefore there was no Exhibit A. <br /> <br /> Mayor Tarver shared Councilmember Pico's concerns about the historical use of the <br />Fairgrounds. He would like the issues resolved now and not have any gray areas or disputes <br />in the future.
