Mayor Tarver asked her if she agreed with the wagering facility use as a historical use. Ms. Michelotti said the wagering facility was already there. Mr. Roush said the idea was to legitimize what was already there. Ms. Michelotti said other events are held in the satellite facilities besides wagering. Mayor Tarvet felt the agreement needed to be modified. He suggested the following changes: remove the reference to Exhibit A; delete the parimutuel wagering satellite facility; and make stables/horse racing training facility a limited facility. Mr. Swift said the historical use section was trying to describe the existing facilities on the site and stating those facilities could continue to function as they have in the past. He explained it would be hard to determine ahead of time what a private and non-private use would be. Exhibit A has been prepared and listed every event that happened at the Fairgrounds in 1996. It was intended to show Council what kind of uses have happened in those existing facilities. It was inadvertently not attached. Mayor Tarver said he would like to see Exhibit A. He understood the whole issue of "for profits" doing a weekend activity and he did not want to discourage this. He preferred the wording to say "and are of a temporary nature". Mr. Pico said he wanted to be cooperative even though he had some concerns, but he understood the City would have the option to contest such issues. If the agreement is approved he would like to attach a letter of clarification on Council's concerns. Ms. Michelotti asked if it would be possible to make up a list of concerns for her to take to the Fair Liaison Committee. She felt this agreement was a positive step in the right direction. Mayor Tarver declared the public hearing open. David Jones, 1605 Rose Avenue, expressed his concerns with the land use agreement, especially with the trailer park. He felt Council would make a wise and fair decision. Ms. Ayala suggested that he attend the Fair Board meetings now that they will be open. There was no further testimony. It was moved by Mr. Pico, and seconded by Ms. Michelotti, to adopt Resolution No. 97-117, approving the Land Use Agreement for the Alameda County Fairgrounds; authorizing the Mayor to sign the attached letter to Alameda County Board of Supervisors and directing the City Manager to forward it to the Alameda County Board of Supervisors.
