Ms. Michelotti understood if any additional structures were built or if the homeowner <br />wanted access off Golden Eagle Drive, a design review process would be required. <br /> <br /> Mr. Swift said yes. Staff would review the plan with notice to the neighbors. <br /> Mayor Tarver would like the homeowner to join the Association. <br /> <br /> Ms. Ayala asked if the Association would exercise control over the structures being <br />built. She did not want a garage built that was visible from Foothill Road. <br /> <br /> Mr. Swift said any proposal would have to go through the design review process at which <br />time Council could decide. <br /> <br /> Mayor Tarver reopened the public hearing. <br /> <br /> Mr. Ardj said it was important that the side and rear setback not be changed. <br /> <br /> Mr. Swift said no change has been discussed. <br /> <br /> The public hearing was closed. <br /> <br /> It was moved by Mr. Pieo, and seconded by Ms. Michelotti, to introduce Ordinance <br />No. 1724, to be read by title only, and waiving further reading thereof, approving PUD--85- <br />15-9M, subject to the recommended conditions of approval for the residential use <br />alternative with the option to allow the homeowner to adjust the setback on Foothill Road <br />from 150 feet to 120 feet if the property owner applied for and was accepted into the <br />Golden Eagle Homeowners Association. <br /> <br /> A substitution motion was made by Ms. Ayala, and seconded by Mayor Tarver, to <br />introduce Ordinance No. 1724, to be read by title only, and waiving further reading <br />thereof, approving PUD-85-15-9M, subject to the recommended conditions of approval for <br />the residential use alternative with the option according to Exhibit B.2 and requiring the <br />homeowner to apply for membership in the Homeowners Association and if the Association <br />accepts the membership, for the Association to assess fees only for services received by the <br />homeowner; landscaping to be in.trolled within six months of occupancy. <br />The roll call vote was aS f0110w~: <br />AYES: Councilmembers - Ayala, Michelotti, and Mayor Tarver. <br />NOES: Councilmember Pico <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br />Pleasanton City Council 09/16/97 <br />Minutes 12 <br /> <br /> <br />
