Mayor Tarver asked if the Homeowners Association had considered letting this property <br />join the Association? <br /> <br /> Mr. Springer felt the Association's main concern was the upkeep of the property. <br /> <br /> Barry Miller, 7880 Cypress Creek Court, President of the Golden Eagle Luxury <br />Homeowners Association, asked Council to reaffirm the Planning Commission' s <br />recommendations. The Association supported the establishment of one single-family dwelling <br />on the property. In regards to the other issues, his Association supported its sister Association's <br />requests. <br /> <br /> Bev Javaheri, 2113 Cascara Court, supported staffs recommendation. She said Mr. <br />Currin had agreed to putting a residence there. She would like the dried grass around the <br />existing driveway maintained and recommended the new homeowner join the Golden Eagle <br />Homeowners Association so the Association can insure property manintenance. <br /> <br /> Ramsey Ardj, 2002 Valley Oak Road, supported the Planning Commission's <br />recommendations in regards to using the facility for a single family dwelling. He did not <br />understand why the Planning Commission did not support conditions 3, 4 and 5 of Exhibit 3B, <br />which he felt were important factors. He would like the PUD adopted with changes that would <br />satisfy everyone's needs and asked Council to consider the above conditions as part of the plan. <br /> <br /> There being no further testimony, the public hearing was closed. <br /> <br /> Mr. Pico understood Mr. Currin to say that he wanted the flexibility of using the PUD <br />conditions of the Golden Eagles Estates to allow larger building envelope as opposed to the <br />Foothill Overlay District. The Homeowners Association has indicated it wanted the property <br />under its control. A compromise that might work would be to add a condition that in the event <br />the property owner elects to join the Homeowners Association and it accepts, then the property <br />would be subject to the 120 ft. setback and be subject to the guidelines of the Association. That <br />would provide flexibility for a future property owner and protection for the Homeowners <br />Association. <br /> <br /> Ms. Michelotti asked if the access at the rear side of the property was an option or a <br />membership requirement? She felt the orientation of the house and the existing driveway was <br />a positive for the property. <br /> <br /> Mr. Swift said it could be an option. <br /> <br /> Ms. Ayala asked if the Foothill Overlay District was put in place so motorists would have <br />a view corridor. <br /> <br /> Mr. Swift said it was adopted after the Golden Eagle Farm PUD was adopted. <br /> <br />Pleasanton City Council 09/16/97 <br />Minutes 11 <br /> <br /> <br />
