Mayor Tarver asked what the difference was between smaller mounted units and Cellular <br />One Unit. <br /> <br /> Ms. Skidmore said Cellular One is a different kind of service. Cellular can transmit <br />voice and data. It is a back and forth transmission that requires larger towers. <br /> <br /> Art Tenbrink, 4265 Mirador Drive, presented petitions signed by 400 residents requesting <br />Council to restrict telecommunications from residential areas. <br /> <br /> Ms. Ayala asked Mr. Tenbrink to read what the petitioners were signing. <br /> <br /> Mr. Tenbrink read "We the undersigned petition the City of Pleasanton to restrict <br />telecommunication towers and other microwave & radio frequency antennae & equipment with <br />commercial applications from residential neighborhoods of our community." <br /> <br /> Mayor Tarver asked where in the Pleasanton Municipal Cede it referred to antennae and <br />when was it adopted. When it was adopted, was it determined if it would be discriminatory to <br />restrict antennae to commercial areas only? <br /> <br /> Mr. Swift said the City adopted their provisions within the last two years that mandates <br />antennae be located in non-residential zones. This particular site is zoned R-1-6500, but it has <br />existing antennae. Because of this, staff treated it as a non-residential site. The cede does not <br />have a separation between commercial and residential lots. It just refers to the zoning. <br /> <br /> Ms. Dennis wanted to clarify that even though the antennae may go into a commercial <br />area, there is a measure of control over the sites that is lost if it is not City property. <br /> <br /> Mr. Roush said the Telecommunications Act of 1996 indicated local zoning is not <br />intended to be preempted. However, the Act put certain limitations on local zoning ordinances, <br />such that these uses cannot be reasonably discriminated against and the City cannot prohibit these <br />type of uses. <br /> <br /> Mayor Tarver asked for clarification on non-residential district versus residential district. <br /> Mr. Roush said district refers to a zoning district. <br /> <br /> Carolyn Chan, 660 Del Sol Avenue, voiced her concerns in regards to the unknown <br />health risks and the high pitched noise factor. <br /> <br /> Brittmade Miller, 4219 Mirador Drive, agreed with the previous speakers.
