lawsuit would follow, that might cost the residents approximately $150,000. The cheapest way, <br />of course, would be not to continue with this ordinance at all. She said Pleasanton does not <br />need this ordinance. <br /> <br /> Ms. Michelotti said this is a very hot issue. She thought at the second reading, when <br />everything was brought back to Council, and if there was still some concerns, a Councilmember <br />would have the opportunity then to vote on a reconsideration. She since has learned, that tonight <br />would be the only opportunity to vote whether to reconsider. She left the meeting on Saturday <br />with one objective: To make sure the ordinance before Council was the best ordinance possible. <br />She commented if there needed to be amendments she was going to bring those forth at/or before <br />the second reading. In the past two days, she has seen the community dividing. She is looking <br />to bring this community together. She welcomed Dorene Paridiso's offer to work on the <br />ordinance. She said the people do not agree with what is adopted, they have the opportunity to <br />set it aside. She has lived here a long time, working and supporting the community. She does <br />not want to see the community divided. Therefore, she has come to the decision to reconsider <br />the action to place the ordinance on the ballot. <br /> <br /> Ms. Dennis said she would support a motion to reconsider. She felt the ordinance will <br />evolve as more information is gathered. <br /> <br /> Mayor Tarver understood it was difficult for residents to understand his support of the <br />ordinance and then to second a motion made by Councilmember Pico to put it on the ballot. He <br />disagreed with the reasons the community had for not putting certain things to the vote of the <br />people. He does not believe the community should be run by a ballot box. He said he is in <br />support of this ordinance. This is not an issue that can be negotiated in a settlement proposition. <br />It is a fundamental question of constitutional rights on one side and emotional rights on the <br />other. He said neither side could be convinced it was wrong. He believed in the residents to <br />make the best possible decision. He believed that the voters will show their support. He does <br />not want to reconsider his decision. He believed the ordinance is needed. He said let the voters <br />overwhelmingly tell the community the ordinance is what it wants. <br /> <br /> Ms. Ayala hoped Council would make a decision tonight in regards to reconsideration. <br />She supported the decision she made on Saturday. She is comfortable that at the second reading <br />there will be some updating regarding the legal ramifications that is going on with Lafayette and <br />West Hollywood. <br /> <br /> Mayor Tarver reiterated again about how the public process works. <br /> <br /> Ms. Acosta clarified the motion is to reconsider whether this item should go the vote of <br />the people and to set a date and time as to when that decision will be made. <br /> <br />Pleasanton City Council 07/15/97 <br />Minutes 9 <br /> <br /> <br />
