Ms. Michelotti commended Mayor Tarver on his efforts for continuing to move this
forward.

It was moved by Mayor Tarver, and seconded by Ms. Ayala, adopting Resolution
No. 97-91, approvlng the Amended and Restated Joint Exercise of Powers Agreement for
the Livermore-Amador Valley Water Management Agency (LAVWMA), dated June 30,
1997.
The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver.
NOES: None
ABSENT: None
ABSTAIN: None

Item 6bl
Approval of Mitigated Negative Declaration for First Street Bridge at Arroyo del Valle
Project, N0. 955029 (SR97:223)

Item 662
ApprOval Of COntraCt Amendment No. 3 with URS Greiner for additional engineerin2
ServiCeS for FirSt Street Bridge at Arroyo del VaHe. Pro_iect No. 955029 (SR97:216)

Roger Higdon presented the staff report.

Ms. Dennis said the report was not clear as to what steps would be taken to guarantee
proper counting of the red legged frog and if mitigation were needed.

Mr. Higdon said Public Affairs Management did the two studies required and found no
evidence of red legged frogs. Since it was determined there are no red legged frogs, then no
mitigation needed to be done.

Scott Steiner, Public Affairs Management, said the surveys were according to protocols
established by the U.S. Fish and Wildlife Service. There were no red legged frogs found.
Therefore no mitigation is required. There is, however, mitigation required for the riparian
habitat that will be affected by the project.

Ms. Dennis said she was concerned about the red legged frog. Is it possible to take the
mitigation a little further and reintroduce the red legged frog back into the environment?

Joan Dulfield said she did all the biological studies required for this project. She found
no sign of red legged frogs. She said the mitigation for the riparian habitat will benefit the
environment for the red legged frog. An abundance of bullfrogs was found in this area. It is

Pleasanton City Council 07/15/97
Minutes 11
