Ms. Michelotti said there were other elected officials from other jurisdictions that
supported the West Dublin BART station as well.

Ray DaSilva, PO Box 2832, Danville, 94526, expressed his concern about the rejection
of his claim against the City. He did not feel Council had participated in the decision. He was
dissatisfied with the whole process.

Mayor Tarver said the City Attorney keeps Council informed of claims against the City.

David Lowell, 1479 Lexington Way, Associate Publisher for the Independent newspaper,
expressed his concern about a change in the specifications for legal ads. He did not feel it was
right to change the specifications by making legal ads available to a daily newspaper only. This
should be a policy decision made by the City Council.

To Mr. DaSilva's comments, Ms. Michelotti said the City Council is kept informed of
each stept in a claim process and that the Council ultimately is responsible for a final decision.

Mayor Tarvet said he appreciated the energy that went into the survey for the Sycamore
area. He wanted to see a solution occur. The difficulty was there are two committees going
full steam and considerable information is needed in order to make the best possible decision.

6.
