Katherine Pittenger, 1912 Toyon Court, said she negotiated the release of the $30,000 <br />obligation from Mr. Currin. All the residents were polled and it was unanimous not to have the <br />trail. It is now much easier to get access to the park; Pleasanton residents only need to show <br />proof of residency to get access to the park. The residents have agreed to turn the money over <br />to the City if a use for it cannot be found within twelve months. Since it was in the PUD as a <br />private amenity and remains so, she would like Council to let the residents handle it. <br /> <br /> There being no further testimony, the public hearing was closed. <br /> <br /> Ms. Dennis said when Golden Eagle was approved there were many amenities that did <br />not come to pass. She agreed with the Planning Commission and felt the trail is a liability <br />problem for the homeowners association. She believed the Council would take a different <br />approach today if it was presented with such an amenity package as was in Golden Eagle. She <br />did not feel a Homeowners Association should have to maintain a trail used by the public. <br /> <br /> It was moved by Ms. Dennis, and seconded by Ms. Ayala, to adopt Resolution No. <br />97-55, denying the appeal and upholding the Zoning Administrator's conditional approval <br />of a PUD modification to eliminate the private pedestrian trail for Golden Eagle Farm, <br />Phase 2, as ~ed under Case AP-97-03/PUD-85-15-3M. <br />The r011 call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, and Pico. <br />NOES: Mayor Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6b <br />Supplemental Weed Abatement Program 1997. (SR97: 177) <br /> <br /> Stewart Gary presented the staff report. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Ernest Jones, 1725 Rose Avenue, said he was dissatisfied with the fire department and <br />objected to the letter he received. He has not seen anyone visiting his property in regards to the <br />weeds. He said he has called upon the fire department several times, but felt the fire department <br />was unable to find his home. He feels a better system should be set up. He suggested a file <br />card system like the one the San Jose Fire Department uses. <br /> <br /> Mayor Tarver asked Mr. Jones if he felt he did not have a weed abatement problem? <br /> <br /> Mr. Jones said he did not.
