It was moved by Ms. Michelotti, and seconded by Ms. Ayala, to introduce Ordinance No. 1714, to be read by title only and waiving further reading thereof, approving the application of Stephen Chambedin Associates/Federal Express for PUD Plan approval as f'ded under Case PUD-97-02, subject to conditions and including a new condition requiring the development to adhere to an estimated number of trips. The roll call vote was as follows: AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver NOES: None ABSENT: None ABSTAIN: None Item 6e Ordinance Providing for Stabilization of Mobilehome Space Rents (SR97: 162) Michael Roush presented the staff report. (Mayor Tarver left the meeting during part of this item.) Mr. Pico said he made the motion to adjust the base rent in December 1996 and it was approved by Council. So why was this ordinance being reintroduced? Mr. Roush said it was being reintroduced in part because of the way the 1992 rents could be determined. One way is simply to back out the inflation factor and come up with $328.55 per space. Another way is for a hearing officer to have some discretion to look at factors that are set forth in the ordinance to determine what would be the correct figure. If a figure were designated, the hearing officer would use that figure. Mr. Pico said there was a considerable gray area about this issue and there had already been a hearing officer determination of a base rent in 1993. He said it was time to put this issue to rest. Ms. Dennis said her concern was that not all the issues would be put to rest. Mr. Roush said the base rent issue would be put to rest. Ms. Michelotti had no problem setting the base rent.
