It was moved by Ms. Michelotti, and seconded by Ms. Ayala, to introduce <br />Ordinance No. 1714, to be read by title only and waiving further reading thereof, <br />approving the application of Stephen Chambedin Associates/Federal Express for PUD Plan <br />approval as f'ded under Case PUD-97-02, subject to conditions and including a new <br />condition requiring the development to adhere to an estimated number of trips. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6e <br />Ordinance Providing for Stabilization of Mobilehome Space Rents (SR97: 162) <br /> <br /> Michael Roush presented the staff report. <br /> <br /> (Mayor Tarver left the meeting during part of this item.) <br /> <br /> Mr. Pico said he made the motion to adjust the base rent in December 1996 and it was <br />approved by Council. So why was this ordinance being reintroduced? <br /> <br /> Mr. Roush said it was being reintroduced in part because of the way the 1992 rents could <br />be determined. One way is simply to back out the inflation factor and come up with $328.55 <br />per space. Another way is for a hearing officer to have some discretion to look at factors that <br />are set forth in the ordinance to determine what would be the correct figure. If a figure were <br />designated, the hearing officer would use that figure. <br /> <br /> Mr. Pico said there was a considerable gray area about this issue and there had already <br />been a hearing officer determination of a base rent in 1993. He said it was time to put this issue <br />to rest. <br /> <br /> Ms. Dennis said her concern was that not all the issues would be put to rest. <br /> <br /> Mr. Roush said the base rent issue would be put to rest. <br /> <br /> Ms. Michelotti had no problem setting the base rent. <br /> <br /> Mr. Pico asked for public testimony. <br /> <br /> (Mayor Tarver returned to the meeting at 11:10 p.m.) <br /> <br />Pleasanton City Council 05/20/97 <br />Minutes 21 <br /> <br /> <br />
