There was no further testimony. <br /> <br /> Ms. Michelotti asked how long it would take to work out the legal issues? <br /> <br /> Mr. Roush said it would not take very long. The attorneys Livermore, DSRSD <br />LAVWMA and Pleasanton have been meeting to discuss legal issues. The legal action will <br />probably be a validation action, which could be accomplished within a matter of a few months. <br /> <br /> Mr. Pico said there had been questions raised about future changes that might require <br />unanimity on the LAVWMA Board and whether or not there were any plans at this point to <br />require that any future changes also be subject to a vote of Pleasanton residents. <br /> <br /> Mayor Tarver said it was each agency' s decision on how it would present it to the public. <br /> <br /> Mr. Roush said there were a number of ways it could be addressed. There will be a <br />third amendment to the JPA and of course that amendment would have to go back to the <br />individual agencies before it would be in effect. One way to handle it might be on the vote <br />itself, similar to the General Plan amendment process. There are ways to insure that if there <br />are to be changes that the voters need to vote on, that such vote would be guaranteed. <br /> <br /> Mr. Pico asked how did Livermore handle it? <br /> <br /> Mayor Brown said it was the opinion of the representatives in Livermore that it did not <br />want to bind Pleasanton or DSRSD to a vote in the future. Livermore will have to work out the <br />terms of the ballot measure. She said right now it is in the form of a resolution that says any <br />additional capacity goes to the voters. It is not part of the Principles of Agreement, it is at each <br />agency's discretion to take to its voters. <br /> <br /> Ms. Michelotti commended Mayor Tarver, Mayor Brown, and the DSRSD Vice <br />President on coming to a resolution. She commented that when the city comes to the vote of <br />the people on this, it is only getting capacity that will build out the General Plan. This is a <br />twenty year plan. It features city centered growth, for the incorporated areas, and this is <br />important to each jurisdiction. Lastly, she wanted to point out that in learning of who will pay, <br />the ratio is about 20 for present residents and 80 for future development. She felt this was a <br />good deal for the present rate payers.
