Hoss Bozorgzad, 675 Marsala Court, supported the gun ban ordinance and would like <br />it moved up on the priority list. <br /> <br /> Jack Dove, 3263 Vineyard Avenue, said there are several items relative to the downtown <br />area. He would like to see them combined rather than approved piecemeal. <br /> <br /> Mayor Tarver commented that the Downtown project is second on the high priority list <br />and has a three year time frame. He asked Council if it wanted to move anything around or add <br />the gun ban ordinance to the highest priority list. <br /> <br /> Ms. Michelotti asked for clarification on the determination of the City's water rights. <br />She noticed that on the white list it was number forty-five and wanted to know that her ranking <br />of this item was based on the timeliness of negotiating a new Zone 7 agreement and not on <br />adjudicating the groundwater basin. She was under the impression that all water issues were <br />lumped together when she ranked the list, but now she sees the contract is separated out. <br /> <br /> Ms. Acosta said the contract is separate from the broader water rights issue to let Council <br />know of the significant amount of work that will be involved in negotiating the new contract. <br /> <br /> It was moved by Mayor Tarver, and seconded by Ms. Dennis, that Resolution 97-21 <br />be adopted, approving City Council Project Priorities 1997/98 as set forth in Attachment <br />D, with an amendment adding the gun ban ordinance to the highest priority list. <br /> <br /> Ms. Ayala said she was not opposed to the gun regulation ordinance. Her concern is <br />with the lawsuits affecting other cities who have put this ordinance in place. <br /> <br /> Mr. Roush commented the primary legal challenge has been the banning of the "Saturday <br />Night Specials." That challenge is taking place in southern California in the West Hollywood <br />case. The initial ruling from the trial court was in favor of upholding the ban. Another issue <br />is the banning of guns at the County fairs, which is also in litigation. It is up to Council <br />whether to wait until these legal issues are decided before moving forward. It will be at least <br />a year before these issues will be decided. <br /> <br /> Mayor Tarvet commented that the City should take the action that is appropriate. <br /> <br /> Mr. Roush commented that if there were legal challenges there are a number of <br />organizations that have offered to help out. He is not overly concerned that Pleasanton's <br />ordinance would be the one to get challenged. There are a number of communities in the East <br />Bay area who have adopted gun regulation ordinances and they would be the one more logically <br />to be challenged.
