Mr. Swift commented the right-of-way shown does not show sidewalks, however if the
development generates pedestrian traffic, a sidewalk would be added and the right-of-way would
come from the property to the north.

Ron Winter, 5506 Sunol Boulevard, representing Spencer Mortuary, said they are
concerned about the site involved. The design does not allow access into their property.

Lewis McKinney, 11624 Jollyville Road, Austin, Texas, representing the Irby Trust, A1
Kaplan, and the Zia Corporation, said his position was to coordinate the joint effort for the
realignment. He believes they have met all the requirements and asks for Council's support and
approval.

Ms. Dennis asked for comment on Mr. Winters concerns.

Mr. Swift said staff has been in contact with Mr. Winter and representatives for the
mortuary. The potential left turn pocket would be shortened, however, the new bridge is being
redesigned to include U-turns for entry from First Street. Staff feels confident that a driveway
could be constructed for the property.

Mayor Tarver commented that he understands what staff is suggesting, but is reluctant
not to have a sidewalk developed in the hopes it will be developed at a later date. He does not
want to see the City giving up any right-of-way.

Ms. Ayala asked staff if the City was giving up any right-of-way.

Mr. Swift commented the proposed design does not have sidewalks on the north side.
What staff is suggesting is for Council to condition this right-of-way alignment to allow for a
sidewalk to be added back should the development on the north side require a sidewalk.

Ms. Michelotti asked where staff would get the right-of-way for the sidewalks if future
development required them.

Mr. Swift commented the right-of-way would come from the property to the north. There
are a number of options that can be looked at. The plan is to have the major trail on the south
side and staff felt this would suffice.

Mayor Tarver said that he was not objecting to staffs design.

It was moved by Mayor Tarvet, seconded by Ms. Ayala, to adopt Resolution 97-14,
approving the revised alignment and street cross-section for Del Va!!e Parkway (between
Stanley Boulevard/Stanley Avenue) with an amendment to the design to include the
sidewalk on the north side.

7 3/04/97
