development is going to change the current lifestyle and she does not want more homes added.
She would like her concerns considered.

Mr. Harlan said Greenbriar is paying an affordable housing fee in addition to the offer
secondary units. He believed the City code allowed for the construction of secondary units and
the State code encourages their construction. The intent is not to double the density of the
project, but rather to offer an option. This proposal was done at the proposal of Council. At the
Planning Commission hearing there were no comments against this. He felt the units addressed
the affordable housing requirement by allowing in-laws, health care providers, or students, the
ability to live and provide a service to the people in the neighborhood. Greenbriar is following
all the guidelines and rules required by the City.

Ms. Ayala asked him to address the issue if the unit is used as a pool house.

Mr. Harlan said then the unit would not be equipped with a kitchen and would only used
as an accessory structure.

Ms. Michelotti asked how big the lots had to be to allow these units.

Mr. Harlan said the secondary units are 756 square feet. The limiting factors would be
the floor to area ratio and the physical setbacks.

Ms. Ayala asked out of the 114 lots, how many are eliminated right away?

Mr. Harlan believed approximately nineteen.

Ms. Michelotti asked how many lots could accommodate detached units.

Mr. Harlan said about 35 percent of the 92 lots.

There being no further speakers, the public hearing was closed.

Mayor Tarver asked staff to explain what could happen if there is no master conditional
use permit regarding secondary units.

Mr. Roush said the state law provides that, assuming certain criteria are met, the City's
discretion to deny secondary units is limited. The City can still look at concerns regarding
aesthetics, parking, traffic, etc., but the area of inquiry is limited. The idea under this proposal
is to limit the number of units.

Ms. Dennis understood this permit only addresses the detached units and there are
options for secondary units within the houses.

Pleasanton City Council 15 01/05/99
Minutes
